PetDentify – Terms of Service

Effective Date: August 10, 2025

Welcome to PetDentify! These Terms of Service (“Terms”) govern your access to and use of the PetDentify website, NFC pet identification tags, any companion applications, and related services (collectively, the “Service”). By creating an account, purchasing a tag, or otherwise using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

1. Acceptance of Terms

You confirm that you have read, understood, and agree to these Terms and our Privacy Policy.
You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and capable of entering a binding contract.

2. Description of the Service

2.1 What is available today (LIVE)

PetDentify provides NFC‑enabled pet identification tags (“Tags”) that, when scanned, display the pet owner’s telephone number so a finder can call immediately. No app is required for the finder to make the call.

2.2 Future features (not currently available)

From time to time, PetDentify may offer additional functionality, which may include items such as Safe‑Circle™ geofence alerts, SMS/push notifications, trusted network notifications, veterinary record storage, lost‑pet posters, and location history. Availability may vary by region and subscription tier and may change at any time.

Additional functionality—including geofence alerts, GPS tracking, and an owner dashboard—is under development and not part of the current PetDentify release.

3. Eligibility & Account Registration

You may need an account to access some features. You agree to provide accurate, complete information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. Subscription & Fees

PetDentify may offer plans that include tags and service benefits. Pricing is presented at checkout and may vary by region. Subscriptions renew automatically at the then‑current rate unless canceled before the renewal date. Taxes, shipping, and handling may apply.

Additional Tags

Additional tags linked to the same account may be purchased at a discounted rate and may inherit the remaining term of an active subscription, if applicable and unless otherwise indicated at purchase.

Free Trial & Promotional Offers

Free trials or promotions may be offered at PetDentify’s discretion. After a promotional period ends, regular subscription rates apply unless you cancel.

5. Shipping, Warranty & Replacements

Limited One‑Year Warranty. PetDentify warrants new Tags against defects in materials and workmanship under normal use for one (1) year from the date of original purchase. During this period, PetDentify will repair or replace, at no charge, Tags that prove defective. This warranty does not cover damage caused by misuse, accidents, or modifications.

Breakage & Loss. If a Tag is damaged after the warranty period or lost, replacement Tags may be purchased at a reduced price plus shipping.

Return Policy. Unused Tags may be returned within 30 days of delivery for a refund (less shipping) if in new, resalable condition.

6. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not: (a) copy or modify the Service; (b) reverse‑engineer or attempt to extract source code; (c) use the Service to harass, abuse, or harm another person or pet; (d) upload or transmit malicious code; or (e) violate applicable laws.

7. User Content

You retain ownership of content you upload (e.g., pet photos, profile data). By submitting content, you grant PetDentify a worldwide, royalty‑free license to host, use, reproduce, modify, and display such content solely to operate and improve the Service. You represent that you have all rights necessary to grant this license.

8. Intellectual Property

PetDentify and its licensors retain all rights, title, and interest in and to the Service, including software, trademarks, and content. Except as expressly permitted, you may not use PetDentify’s trademarks without prior written permission.

9. Privacy

Our Privacy Policy explains how we collect, use, and share your information. By using the Service, you consent to our data practices as described therein.

10. Third‑Party Services

The Service may contain links to or integrations with third‑party services (e.g., SMS gateways, mapping APIs). PetDentify is not responsible for third‑party content or services and your use of them is at your own risk.

11. Disclaimers

The Service is provided “as is” and “as available.” PetDentify disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. PetDentify does not guarantee that use of the Service will result in the recovery of a lost pet or that the Service will be uninterrupted, secure, or error‑free.

12. Limitation of Liability

To the fullest extent permitted by law, PetDentify will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. In no event will PetDentify’s total liability exceed the greater of (a) the amounts you paid PetDentify in the 12 months preceding the claim or (b) fifty (50) U.S. dollars.

13. Indemnification

You agree to defend, indemnify, and hold PetDentify and its affiliates harmless from any claims, damages, or expenses arising out of your misuse of the Service or violation of these Terms.

14. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease; however, Sections 7, 8, 11, 12, 13, and 16 will survive termination.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict‑of‑law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Cook County, Illinois.

16. Dispute Resolution & Arbitration (Optional)

At PetDentify’s sole discretion, disputes may be resolved through binding arbitration in Chicago, Illinois under the rules of the American Arbitration Association. You and PetDentify waive the right to participate in class actions.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the app or by email at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
